D&I advised the FCCA

D&I advised the Finnish Competition and Consumer Authority in a case where the Market Court ordered Valio to pay the largest ever sanction imposed on an individual company due to breach of competition law. i.e. a EUR 70 million fine due to predatory pricing. The second largest sanction was the EUR 68 million fee imposed on Lemminkäinen Corporation for the nation-wide asphalt cartel, where the FCCA also was advised by D&I.

Asphalt Cartel

D&I acted for a number of claimants in precedent-setting antitrust damages litigation following the conviction of a nation-wide asphalt cartel. The claimants won on almost all points of the law and the court ordered the respondents to pay EUR 37.4 million in damages, costs and interest.

Motor Vehicle Spare Part Cartel

D&I represented one of five Finnish motor vehicle spare part wholesalers in a national cartel investigation in all administrative instances. D&I is also involved in the follow-on private litigation, where a competing wholesaler claims joint and several compensation of approximately EUR 55 million based on alleged damages from the cartel in a public court of law.

Pharmaceutical Companies and Competition Law

D&I continuously advises companies in the pharmaceutical field, for instance, relating to dominance issues, distribution arrangements and public procurement matters.

Finnish Competition Authority

D&I assisted the Finnish Competition Authority that for the first time involved an outside litigation counsel to assist in the largest Finnish cartel case to date.

European Commission

D&I is involved in involved in a high profile state aid case before the European Commission where the Commission is asked to investigate whether the  financial support provided by the city of Helsinki to its bus transport company constitutes illegal state aid.

Veho Group

D&I assisted Veho Group, the largest Finnish car importer, in the investigation of the Finnish competition authority involving alleged violation of certain provisions of the EU Motor Vehicle Block Exemption Regulation. The authority accepted the commitments offered by Veho and ended the investigation.

Global IT Company

D&I successfully defended a global IT company in an investigation of the Finnish Competition Authority regarding distribution arrangements. The investigation was closed.

Suomen Numeropalvelu

D&I represented Suomen Numeropalvelu (SNOY), a national provider of wholesale telephone directory information, against allegations of abuse through unjustified refusal to provide directory information to Eniro for purposes of free internet distribution in all administrative instances. The Supreme Administrative Court confirmed that SNOY had the right to refuse to provide directory information for internet distribution after the implementation of the relevant data protection directive but did not have a justified reason to refuse to provide directory information before the directive was implemented in Finland. 

Eurocash Oy

D&I assisted Eurocash Oy, an independent ATM operator, which submitted a complaint to the Finnish Competition Authority relating to alleged abuse of joint dominant position of Automatia Pankkiautomaatit Oy and certain Finnish banks which own Automatia. Automatia operates the national OTTO ATM system. In June 2009 the FCA gave a commitment decision in which the banks agreed to lower the fees charged from consumers for using other than OTTO ATM's.
